3. Eligibility

3.1 Age Requirements

You must be at least 18 years of age to use our services. If you are under 18, a parent or legal guardian must create the account and agree to these Terms on your behalf.

3.2 ITIN Eligibility

By using our services, you represent and warrant that:

  • You are not eligible for a Social Security Number (SSN)
  • You have a valid tax purpose for obtaining an ITIN
  • You are not a U.S. citizen
  • All information you provide is accurate and truthful
  • You have the legal right to submit the documents provided

3.3 Geographic Restrictions

4. User Obligations

5. Fees and Payment

5.1 Service Fee

All-Inclusive Pricing: $299 USD

Our fee covers all aspects of the ITIN application assistance service, including document review, form preparation, submission, and support. There are no hidden fees or additional charges.

5.2 Payment Terms

  • Payment is due in full before service commencement
  • We accept major credit cards, debit cards, and PayPal
  • All fees are in U.S. dollars
  • Prices are subject to change with 30 days notice
  • The IRS does not charge a fee for ITIN applications

5.3 Refund Policy

Full Refund Available If:

  • You cancel within 24 hours of payment AND before we begin processing
  • We determine you are ineligible for an ITIN before submission
  • We are unable to provide the service due to our error

Partial Refund (50%) Available If:

  • You cancel after we begin processing but before IRS submission
  • You fail to provide required documents within 30 days

No Refund If:

  • Application has been submitted to the IRS
  • IRS rejects or denies your application
  • You provided false or misleading information
  • You violated these Terms of Service

5.4 Currency and Taxes

All prices are in U.S. dollars. You are responsible for any applicable taxes, duties, or fees imposed by your country of residence. Our prices do not include such taxes unless explicitly stated.

6. Processing and Timeline

6.1 Processing Time

IRS processing times typically range from 6-12 weeks but may vary based on:

  • Time of year (longer during tax season: January-April)
  • Completeness of application
  • IRS workload and staffing
  • Country of origin
  • Document complexity

6.2 No Guarantee of Timeline

We do not control IRS processing times and cannot guarantee when you will receive your ITIN. Any timeframes provided are estimates based on historical data.

6.3 Our Service Timeline

  • 1-2 business days:Initial review of your submission
  • 3-5 business days:Document verification and form preparation
  • 5-7 business days:Submission to IRS (after all documents received)
  • 6-12 weeks:IRS processing (beyond our control)

7. Intellectual Property

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use our website and services for your personal ITIN application needs. This license does not include rights to:

  • Use data mining, robots, or similar tools
  • Remove copyright or proprietary notices

7.3 User Content

8. Prohibited Uses

9. Disclaimers

9.1 No Guarantee of Approval

WE DO NOT GUARANTEE ITIN APPROVAL. The IRS makes all final decisions regarding ITIN applications. Our 99.8% historical success rate does not guarantee your individual application will be approved.

9.2 No Legal or Tax Advice

Our services are limited to administrative assistance. We are not attorneys, CPAs, or enrolled agents. Information provided is for general guidance only and should not be construed as legal or tax advice.

9.3 Third-Party Services

We are not responsible for services, content, or practices of third-party websites or services linked from our site. Your use of third-party services is at your own risk.

9.4 Service Availability

10.3 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental or consequential damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless TheITINapp.com, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

We may terminate or suspend your account immediately, without prior notice, if:

  • You engage in abusive behavior
  • You fail to pay fees owed

12.3 Effect of Termination

Upon termination:

We retain records as required by law, including IRS regulations requiring 7-year retention of tax-related documents.

13. Dispute Resolution

Before filing any legal action, you agree to try to resolve disputes informally by contacting us at legal@theitinapp.com. We'll try to resolve disputes informally for 30 days from the date of first contact.

13.2 Binding Arbitration

If informal resolution fails, disputes shall be resolved through binding arbitration, except where prohibited by law.

  • Arbitration will be conducted by JAMS under its rules
  • Arbitration will be held in Delaware or your county of residence
  • The arbitrator's decision will be final and binding
  • Each party bears its own costs unless the arbitrator determines otherwise

13.3 Class Action Waiver

You agree to resolve disputes only on an individual basis and waive any right to bring or participate in a class action, class arbitration, or representative action.

13.4 Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. You consent to the exclusive jurisdiction of the state and federal courts located in Delaware.

13.5 International Users

If you access our services from outside the United States, you do so at your own risk and are responsible for compliance with local laws. You agree that the United States law governs these Terms and any disputes.

14. General Provisions

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TheITINapp.com regarding our services.
